EUDR becomes applicable on December 30, 2024, for large companies and non-SME traders. Micro and small enterprises have until June 30, 2025.
What are the penalties for non-compliance?
Penalties include fines up to 4% of annual EU turnover, product confiscation, and potential EU market access bans for repeat offenders.
Do existing certifications guarantee EUDR compliance?
No. While certifications like FSC or RSPO support compliance, they don't automatically meet EUDR's specific requirements, particularly the December 31, 2020 cutoff date and precise geolocation requirements.
How precise must geolocation data be?
For areas under 4 hectares: point coordinates (latitude/longitude). For areas 4 hectares or larger: polygon mapping with defined boundaries.
Can I rely on supplier declarations for compliance?
Operators and non-SME traders must conduct their own due diligence. SME traders can maintain databases of supplier DDS numbers but must verify the authenticity of declarations.
What happens if I discover a high-risk supplier?
You must implement risk mitigation measures, which may include additional documentation requests, third-party audits, or supplier replacement if risks cannot be reduced to negligible levels.
How long must I keep EUDR compliance records?
All compliance documentation must be stored for a minimum of five years and be readily available for regulatory audits.
Does EUDR apply to products in transit before the implementation date?
Products already in transit or placed on the market before the applicable dates are generally exempt, but specific legal advice should be sought for individual situations.
